Terms & Conditions
The terms for using Mavixa’s website and understanding how our services are proposed, delivered and governed.
These terms describe Mavixa's public website and services. Client projects may have their own agreements, service schedules and privacy obligations.
01. About these terms
These Terms of Use govern access to the Mavixa public website at mavixa.com.au and, where applicable, the Mavixa Outreach System by authorised users. The website is operated by Mavixa LTD, a company incorporated in the United Kingdom, at Office 22009, 182–184 High Street North, East Ham, London, United Kingdom, E6 2JA. We serve clients in Australia and internationally. Separate written agreements govern particular client projects, pricing, deliverables and services; if they conflict with these general website terms, the signed agreement prevails for that engagement.
02. Using the website
You may browse and use the website for legitimate information and business enquiries. You agree not to disrupt or misuse the website, attempt unauthorised access, introduce malicious software, scrape or extract information in a manner that damages the service or violates applicable law, or misrepresent your identity in communications with us.
03. Services, proposals and pricing
Descriptions of our services, case examples, indicative benefits, audit offers, and pricing information are general information, not a binding promise or offer to perform specific work. Scope, deliverables, implementation schedule, fees, support, ownership, integrations, and payment terms will be defined in an accepted proposal or separate agreement. An initial consultation or audit does not create an ongoing service relationship unless agreed.
04. AI and healthcare-related features
Motion and other AI-enabled tools may generate automated responses and support administrative workflows such as enquiry handling and appointment requests. They are not medical devices or substitutes for healthcare professionals unless expressly agreed and appropriately validated for a particular regulated purpose. AI outputs may be incomplete, inaccurate or unsuitable for individual circumstances.
Clinics remain responsible for clinical decisions, triage protocols, patient-facing statements, privacy notices, consent processes, and compliance obligations relating to their use of our systems. Do not rely on this website or a website chatbot for emergencies, diagnosis or urgent medical care.
05. Your materials and integrations
If you send us content, credentials, specifications, or other materials, you represent that you have the rights and authority to provide them for the agreed purpose. You are responsible for the accuracy of your instructions and for maintaining secure access to any client-owned accounts. Specific arrangements for integrations, personal information, intellectual property, and access permissions should be documented in the relevant engagement agreement.
06. Intellectual property
Unless otherwise stated, the website's copy, branding, layout, graphics, and original materials are owned by or licensed to Mavixa and protected by applicable intellectual property laws. You may view or print reasonable portions for personal or internal business evaluation but may not republish, sell, or exploit them without permission. Ownership of custom client deliverables is governed by the relevant signed project agreement.
07. Third-party websites and services
Our website may link to booking platforms, external applications, portfolios, or third-party providers. Their terms and policies apply independently. We do not control and are not responsible for external websites or interruptions to third-party services beyond our reasonable control.
08. No guaranteed outcomes
We aim to provide accurate descriptions of our work, but the website is provided on an “as available” basis. We do not guarantee particular search rankings, traffic levels, appointment volumes, enquiry conversion rates, clinical outcomes, or uninterrupted operation based solely on information presented here. Any specific service warranties or performance commitments must be set out in a signed agreement.
09. Liability and statutory rights
To the extent permitted by applicable law, Mavixa is not responsible for indirect or consequential losses arising solely from reliance on general website information or temporary website unavailability. Nothing in these terms excludes, restricts, or modifies any right, remedy, guarantee or liability that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law.
10. Privacy and communications
Our handling of personal information is described in our Privacy Policy. If you contact us or submit a website enquiry, you consent to receiving communications relevant to your enquiry. Marketing communications are handled in accordance with applicable law and opt-out preferences.
Authorised users of the Mavixa Outreach System who connect Google services must only connect accounts they control or are permitted to administer, and must use Gmail and Google Sheets features in accordance with Google’s terms and applicable anti-spam and privacy laws. Details of the permissions, purposes, retention and revocation are provided in our Privacy Policy's Google account and API data section.
11. Changes, jurisdiction and company details
We may update these terms periodically, and the effective date above identifies the version shown. These website terms are governed by the laws of England and Wales, subject to any mandatory consumer or other protections applicable in your jurisdiction. Unless mandatory law provides otherwise, courts in England and Wales have jurisdiction for disputes about use of the public website. A signed client agreement may specify different dispute-resolution terms.
